most evidence points to ursa but others have brought up the point that ozai was being an eveil mastermind and planned for ursa to kill azulon. others say azula did it .

I said way back in 2006 that Ursa took him out after learning Ozai was going to kill Zuko. It couldn't have been a simple "Ursa killed him and ran away" dealie because somehow Iroh's birthright was given to Ozai, as per Azulon's "dying wish". All we know is Ursa "hatched a plan" and did "treasonous things" that night that.

Ursa did indeed hatch a plan .but there are confusing parts to the plan:

-she got iroh to not complain about his birthright getting taken away.(fact)

-she had to have told azula something of this plot because azula clearly was hiding something.(opiniated)

She didn't have to tell Iroh anything. Iroh was all depressed and whatnot from losing his son, I doubt he really cared about being fire lord. (And he probably had to go on his spirit world trip.)

even if he was depressed he would have been heading back to the palace. and what would he say when he saw ozai sitting atop the throne?

Why would he necessarily be heading back to the palace?

From what we've seen, Lu Ten's death was the turning point in Iroh's life, making him go from a pretty typical FN royal to the actual human he is. I'm guessing these things took place between Lu Ten's death and his return to the palace:
    -Spirit World journey
-Observing waterbenders and developing his lightning technique
-Discovering the Order of the White Lotus

I really think that Ozai was plotting the whole think, no matter how it happened, just like Azula plotted out the fall of Ba Sing Sa
